A £40,000 a year West Midlands group sales and marketing director who claimed he was owed £20,000 in unpaid bonus and commission payments has been awarded less than £3,000.

Glen Besley of New Rowley Road, Dudley, had been employed by Transcend Group Ltd of Offenham, Worcestershire, which specialises in the education, development and training of work based employees under the Skills Funding Agency.

The firm carries out work in Bahrain, Dubai, Malaysia and Saudi Arabia apart from the UK.

Mr Besley had been employed from March to November 2013 after the firm’s managing director, Roger Edmonds, had known him for 12 years, Birmingham Employment Tribunal was told at a previous hearing.

Mr Besley, who made a legal claim for the unlawful deduction of wages, said he used his own car for visiting clients for which he was paid £35 a day.

He accused the firm of failing to pay his travelling expenses and said he had been astonished to be told he was losing his job. He said he was owed a total of about £20,000.

The firm oppposed Mr Besley’s unpaid wages claim and said he was not entitled to the payments.

Cuts needed to be made by the respondents after failing to win new business, the tribunal had been told at the previous hearing.

The firm also alleged Mr Besley had failed to provide certain requirements” and had not reached targets. He was further accused of talking to a major competitor, which he denied.

Tribunal judge Charles Wynn-Evans said at the previous hearing he would make a decision at a later date.

Now he has decided that Mr Besley should be awarded £2,364 after being successful in his legal claim for the unlawful deduction of wages.

But Mr Wynn-Evans rejected Mr Besley’s claim for travelling expenses.
