PUBLIC NOTICE ABOUT APPEALS NOISE INSULATION REGULATIONS 1975 M5 JUNCTION 4A - 6 SMART MOTORWAY SCHEME
The M5 Junction 4a-6 Smart Motorway Scheme was opened to traffic on 26 May 2017. Offers of insulation (double windows, perhaps doors, special ventilation and in some cases Venetian blinds) or an equivalent grant have been made to the occupiers (and/or landlords) of all residential properties which are believed to qualify under the Noise Insulation Regulations 1975. In this instance no properties were deemed eligible.

Where no offer of insulation or grant has been made the Regulations give a right of appeal to the occupier or person entitled to occupy any dwelling or other residential property (such as an old people's home or hostel for long-stay residents), and to his/her immediate landlord or licensor (if any), where the dwelling or property is within 300 metres of the scheme. Any person who claims that use of the new improved length of road causes or is expected to cause noise greater than the level specified in the Regulations may appeal in writing to Highways England, Major Projects Division, 5 St Phillips Place, Birmingham, B3 2PW. The appeal should set out the facts and request that an offer of insulation or grant be made in accordance with the provisions of the Regulations. This right of appeal must be exercised not later than 28/02/2018.
