THE JURY in the trial of a Netherton man and his nephew who are accused of the brutal killing of a 32-year-old man were retiring to consider the evidence for a second day today (Thursday).

The jury deliberated for nearly five hours at the end of the summing up by a Judge at Wolverhampton Crown Court yesterday (Wednesday October 14),before being sent home for the night.

Amjad Khan died from head injuries five days after the incident at a flat in Yardley Close, Bristnall Fields, Oldbury, last June.

In the dock are 33-year-old Derek Brennan, of Halesowen Road, Netherton and his 23-year-old nephew Damon Sehra, of no fixed address.

The prosecution have alleged the pair violently attacked Mr Khan who was repeatedly struck on the head with a bottle and a children's toy.

He suffered the injuries within 10 minutes of calling at the flat which was the home of Sehra's mother, the jury were told.

In evidence Sehra maintained Mr Khan had told his mother to take off her clothes in exchange for drugs and that lead him to lose control and go "berserk."

Brennan said Sehra was responsible for the savage attack with police officers finding Mr Khan lying in a pool of blood after responding to a 999 call.

Sehra has denied murder but admitted manslaughter on the grounds of diminished responsibility while Brennan has pleaded not guilty to murder and manslaughter.

Sehra has further denied a charge of attempting to cause grievous bodily with intent but he has admitted assault causing actual bodily harm.

Brennan has also pleaded not guilty to causing grievous bodily harm and to a further charge of assault causing actual bodily harm
