A STOURBRIDGE man who threw a glass at a pub landlord after being told to leave has avoided jail.

George Fox suffered a cut to the side of his head and a black eye after he was also punched by Daniel Lea, Wolverhampton Crown Court was told.

Mr Fox, licensee at the Sampson and Lion pub, Wordsley, had told Lea and his friends to go because of their rowdy behaviour, said Ian Windridge prosecuting.

He said 20-year-old Lea, who had a previous conviction for battery, then went to the bar to ask for another drink and, when he was refused, he threw the pint beer glass.

Lea, of Belbroughton Road, admitted assault causing actual bodily harm and he was given an 18-month community order, placed on supervision for a year and also ordered to carry out 100 hours community punishment.

Recorder David Herbert also told him to pay £480 compensation to Mr Fox for his injuries and said; "You do not seem to be acting in a responsible way.

"This offence was committed in the presence of children and your own child. You have got a growing troublesome record and you thoroughly deserve to go the prison."

He told Lea, whose father runs glassware and gardening businesses: "If you can afford to pay to drink in excess you can afford to pay for the consequences. You have avoided going into custody by the skin of your teeth."

Sally Hancox, for Lea, told the court her client was "deeply ashamed and 100 per cent sorry" for his "foolish" actions.

She went on: "He had the glass in his hand when he lost his temper. He was also wearing a significant sovereign ring on the hand he used to punch this licensee."
